A New York State Supreme Court judge has dismissed two breach of contract claims against developer LPCiminelli.

The Buffalo Public School District has filed a lawsuit against the developer, claiming it cheated taxpayers.

The district hired LPCiminelli to renovate 48 schools starting in 2002, giving the developer a contract worth $1.3 billion.

But the actual work cost less than that to complete, and the district claims LPCiminelli pocketed the rest of the money.

At the time, the developer’s lawyers said the cost was well within normal range for such a large project.

Late Thursday, a judge ruled the district must pay more than $3 million in outstanding payments, with interest.

BPSD has yet to respond to requests for comment.
