The Buffalo Police officer who hit a woman while she crossed Hertel Avenue last week was not using his lights and sirens.

Captain Jeff Rinaldo confirmed Thursday morning that the officer was responding to a call for service, but not an emergency, on March 30 when he hit 64-year-old Susan LoTempio. She was out for her morning walk.

The officer was not required to use the lights and sirens, Rinaldo said.

"I don't β€” wouldn't wanna say that that's what led to the woman's death. I would say that as part of our investigation, we look at the response to any call for service and whether it fell within our policy,” he said. β€œAt this point, we do not believe that speed was a factor but again we're waiting on the final accident reconstruction from the state police."

Buffalo police have handed over the case to state police to conduct an independent investigation.
