ROCHESTER, N.Y. — The Rochester City School student accused of making a terroristic threat against East High School was arraigned Thursday morning.

No bail and no release was the ruling by judge Dinolfo in the case of Edison tech student, 21-year-old Abigail Hernandez, who pleaded not guilty at her arraignment. Hernandez is facing two counts of making terroristic threats.

“They are both punishable by up to 7 years in prison. There are other sentences which are allowed but that would be the maximum sentence,” said prosecutor, Gregory Colavecchia. 

According to court paperwork, Hernandez threatened to shoot up East High School on February 15th. Hernandez is being accused of making a fake Facebook account under the name Martin Doll to make the threat. According to defense attorney Clark Zimmermann, Hernandez's mental capacity is a concern and he is looking into getting a mental health examination done for his client.

“In speaking with her, she does have some limitations in her ability to comprehend, so that all goes towards intent and whether or not she had an intent to even form what she's charged with,” said Hernandez`s attorney, Clark Zimmerman. 

Outside of the courtroom, people who know Hernandez said she has special needs.

“There's no way she would harm that school or anyone. She loved the school. Let's find the person that set her up and did it and let's get her home to her family,” said friend, Karen Fox.

Hernandez is facing two felony counts along with the possibility of being deported if she is found guilty. Hernandez is from Mexico and is living in the United States under DACA.

“If she were to be deported, it would be like putting an elderly person on a flow of ice to fend for themselves. There`s nothing for her down there,” said Fox.

Hernandez has been transported and will be held at a local jail.

Jury selection has been set for August 20th.
